General terms and conditions

Article 1 - This contract is about the rental of the VILLA ART NATURA gite at 12 route de Montauban 31110 JUZET-DE-LUCHON.

 Article 2 - length of stay: The tenant has signed this contract for a fixed duration and may not, under any circumstances, claim any right to remain in the premises at the end of the stay.

 Article 3 - conclusion of the contract: The reservation becomes effective as soon as the tenant has sent to the owner the 25% deposit mentioned in the contract, as well as a copy of the contract signed before the date indicated on the contract. A second copy is to be kept by the tenant.

The rental concluded between the parties to the present deed may in no case, even partially, benefit third parties, natural or legal persons, unless if the owner agrees in writing.
Any violation of this last paragraph could result in the immediate termination of the rental at the expense of the tenant, the rental proceeds remaining definitively acquired by the owner.

Article 4 - rental payment: the balance of the rental must be paid 30 days before entering the premises by a bank transfer to the owner's account.
If the reservation takes place within 30 days before entering the premises, the rental price must be paid in full when booking.

Article 5 - absence of withdrawal: For reservations made by mail, telephone or internet, the tenant does not benefit from the withdrawal period, and this in accordance with article L121-21-8 of the consumer code relating in particular to hosting services provided on a specified date or periodicity.

Article 6 - cancellation by the tenant: Any cancellation must be notified to the owner, with acknowledgment of receipt, by letter or by email. The deadlines considered are counted from the knowledge by the owner.

a) cancellation more than 30 days before the arrival date:
the deposit remains with the owner, or is deductible for the next stay.
If the tenant had already paid the entire stay, the owner will reimburse the tenant the price of the stay less the 25% constituting the deposit.

 b) cancellation within 30 days before the arrival date:
The rental price remains with the owner. There will be no refund.

c) if the tenant does not appear within 24 hours of the arrival date indicated on the contract, this contract becomes void and the owner can dispose of his gite.
There will be no refund.

 d) if the stay is shortened, the rental price remains with the owner. There will be no refund.

Article 7- cancellation by the owner: When the owner cancels the stay before the start of the stay , he must inform the client, with acknowledgment of receipt. The owner pays the tenant the full amount paid in advance.


Article 8 - arrival: The tenant must appear on the day specified in the time slot mentioned on this contract. In the event of late or delayed arrival, the tenant must notify the owner.

Article 9 - incoming inventory of fixtures: An inventory is drawn up jointly and signed by the tenant and the owner or his representative on arrival and departure from the gite. This inventory is the only reference in the event of a dispute concerning the inventory.
The state of cleanliness of the house upon arrival of the tenant must be noted in the inventory. The cleaning of the premises is the responsibility of the tenant during the rental period. In the event of abnormal use of the premises, or exceptional soiling, the amount of the additional cleaning costs will be billed to the tenant.

 Article 10 - security deposit: On arrival of the tenant, a security deposit is requested by the owner. Its amount is indicated in this contract. When the contradictory establishment of the inventory of fixtures is done, this deposit is returned, after deduction of the cost of restoration of the fixtures if degradations were noted, within 15 days following the departure of the tenants.

In case of early departure (earlier than the time mentioned on this contract) preventing the establishment of the inventory on the day of departure of the tenant, the deposit is returned by the owner within 15 days after deduction of the cost of restoring the premises if damages were observed by the owner.

 Article 11 - use of the premises: The tenant must ensure the peaceful nature of the rental and make use of it in accordance with the destination of the premises.

 Article 12- capacity: This contract is established for a maximum capacity of 12 people. If the number of tenants exceeds the accommodation capacity, the owner can refuse additional persons. Any modification or breach of contract will be considered on the initiative of the client.

Article 13 - rules and regulations: This contract specifies:
a) the gite is non-smoking;
b) animals are prohibited;
c) festive events are prohibited;
d) the fireplace in the living room is only decorative; it is strictly prohibited to make fire inside it.
In case of non-compliance with one of these clauses by the tenant, the owner can refuse or shorten the stay. In this case, no refund will be made.

Article 14 - insurance: The tenant is responsible for all damage arising from their act. They must be insured.

Article 15 - payment of charges: The charges for water and electricity are included in the rental price, for a normal use.

Article 16 - disputes: Any complaint relating to the rental will be dealt with by the competent court.
